Britain Now Part of The Muslim World
Friday, September 19, 2008 19:50 | This post has been viewed 663 timesMaybe Britain wasn’t ready, maybe it was and even if it wasn’t, they have willingly or unwillingly become part of the Muslim world. Let me say something here, it is not a publicity stunt when you become a part of the Muslim world, it just puts you down even more.
You ask, how did all this happen? Apparently there is a clause in the UK Arbitration Act 1996 which classifies the Sharia court as arbitration tribunal. The rulings of arbitration tribunals are binding in law, provided that both parties in the dispute agree to give it the power to rule on their case.
In other words, I could decide if I want to go to a Sharia court or the Real court. It would be interesting to see who gets to decide when both parties cannot seem to make an agreement. I would go to the court which has the most favorable ruling for me, won’t I? This will result in a deadlock and one party will definitely be a loser.
There is no question that Islam tends to look at men in a more favorable way than women and that will make the Sharia courts very interesting because the side that loses will always want to pursue second opinion from traditional courts if they believe that the Sharia court was unjust.
According to TimesOnline:
“In a recent inheritance dispute handled by the Sharia court, the estate of a Midlands man was divided between three daughters and two sons. The judges on the panel gave the sons twice as much as the daughters, in accordance with Sharia. Had the family gone to a normal British court, the daughters would have got equal amounts.”
As you can see, there is already a problem. That’s not it, the article goes on to say:
“In the six cases of domestic violence, Siddiqi said the judges ordered the husbands to take anger management classes and mentoring from community elders. There was no further punishment. In each case, the women subsequently withdrew the complaints they had lodged with the police and the police stopped their investigations.”
It doesn’t really make sense that the law that has been shunned in Muslim countries is now being adopted in non-Muslim country so that a relatively small part of the population can be appeased. Here in the U.S. it is all about separation between church and state and this happens to be the strength of this country. I am in no way implying that the U.S. is not a Christian country but at least I am not treated inferiorly or superiorly in the eyes of law when it comes to legal system. I am not asked to swear on the bible in front of jury and that’s how it should be in the court of law. Having a Sharia court and a Regular court is like going “opinion hunting”, it has nothing to do with jsutice.

The writer seems to be having no deep understanding about what Islam says about the distribution od wealth among men and women of the faimly and why Islam preachsto practice so garding this issue.
Islam does not favour anyone be it a man or woman.Islam asks to give woman less share as the woman has to get married and settle in some other faimly where she wiil be posseing her own share along with that of her husband(he would inherit that from his own faimly).Does it show Islam favouring men?No way.In fact this practice creates balance in the society.

You have a right to your opinion Tahir, it doesn’t change the reality on the ground that Men have made Islam more favorable to them even though Islam might dictate balance between two sexes. Sharia law is all about interpretation and cannot be looked at verbatim. It can be twisted to favor one party or the another.
The balance you talk about in the society is not reflected on the ground and you know that as well as I do, I talk about what I see with my eyes and don’t consider perfect scenarios where every human being is well versed with the Islamic code.

There are problems in bringing established sharia laws into action in countries where sharia courts exist depending upon the interpretations, as you wrote, that may apparently be favoring one party. True that Islam gives men more powers than women but to see why does it say so is important. Taking just the literal meaning isn’t really going to help in any way.
My point here is Quran. The law in case of inheritance is straight away given by Quran. It needs no interpretation to the extent when we are discussing the formula of dividing the wealth of the deceased among his/her family members. We dont have to argue on this right? You might be seen as over-stepping the so-called western values of “equality” when you obey any such Quranic verse, but being a muslim, acting upon Quran does hold its own spiritual and worldly benefits. Quran’s claim surely needs more explanations to it by learned scholars in Islam.

Well sure, Sharia Laws can be interpreted however you like. Just like the Bible and the Koran. But I think what matters is how they are currently being interpreted. If you've actually seen the full extent of what Sharia Law is generally used for in its home countries, its definitely a bad thing for women's rights. Nevermind the fact that thousands of women fleeing countries because of Sharia Laws. Nevermind the sheer number of Sharia horror stories that are already published, or all of the existing opposition for it. What do those people know? Just listen to that one person tell you that Sharia Law is not a bad thing, and tada! – it's not a bad thing anymore. He obviously knows more about Sharia than you do, so he has to be right, right? Otherwise, you're just an Islamophobe and a bad person.
